Samsung has finally won the right to officially sell its Galaxy Tab 10.1 Android tablet in Australia, following the Federal Court of Australia's decision to reject Apple's request to appeal today.

The decision means that Samsung will officially sell the Galaxy Tab 10.1 Android tablet in Australia from late next week. Samsung has confirmed a Wi-Fi only 16GB version of the tablet will sell for $579, while a 3G variant of the same model will sell for $729.

Samsung confirmed the Galaxy Tab will be available from "leading Australian retailers" including Harvey Norman, JB Hi-Fi, The Good Guys, Myer, Bing Lee and Officeworks.

"As the High Court has today rejected Apple's leave to appeal, Samsung Electronics Australia is pleased to announce the highly anticipated Samsung Galaxy Tab 10.1 will be available in stores in time for the Christmas shopping period from a RRP of $579 (16GB Wi-Fi variant) and a RRP of $729 (16GB 3G variant)," the company said in a statement.

"Samsung Electronics Australia is pleased with today's judgment by the High Court of Australia to deny Apple's request to appeal the decision of the Full Court. The Full Court of Australia decision on November 30 clearly affirmed our view that Apple's claims lack merit and that an injunction should not have been imposed on the Galaxy Tab 10.1."

The two companies have been battling it out in court since October, with Apple claiming that the Samsung Galaxy Tab 10.1 copied its iPad 2 tablet and breached various patents. The Federal Court initially granted Apple a temporary injunction which meant that Samsung could not sell, advertise, or even take pre-orders until the court case had been resolved.

Last week, the Federal Court overturned the initial preliminary injunction against the Galaxy Tab 10.1, but Apple applied for leave to appeal to the High Court of Australia and was granted a short stay until today.

Despite the previous injunction, many online retailers have already sold the Galaxy Tab 10.1 in Australia including MobiCity, Kogan, Millenius, Expansys, Techrific and dMavo.

Samsung has already launched the Galaxy Tab 10.1 in various other markets including the US and Europe.
